Provider and scope
Moket is provided by Mirko Genovese, Ziegeleistr. 53B, 86199 Augsburg (“we”). These terms apply to the Moket app and its web pages. By signing up you accept them.
What Moket is
Moket is a free community app for motorcyclists: encounters after a ride, contact requests and chat, group rides, meeting points, road reports and creator pages. Moket is not a navigation device or a safety system.
The app is in a test phase. Features may change, fail or be removed; there is no right to any particular availability.
Account
You must be at least 18. One account per person. Your details must be true; your nickname must not infringe others’ rights or impersonate anyone. Protect access to your email: whoever controls it can sign in.
Road safety
Traffic law always comes first. While riding, only use the app with the phone mounted and when a brief glance or tap is enough (§ 23(1a) StVO); otherwise stop. Speed limit, temperature and reports may be wrong or outdated; road signs and the real situation always apply.
In Germany drivers may not use features that warn of traffic enforcement (§ 23(1c) StVO). There, do not use the “Hand on helmet” (check) report and do not act on such warnings. You alone are responsible for violations; the same applies to similar rules in other countries.
Conduct and content
The community rules apply. You are responsible for everything you post (profile, messages, rides, meeting points, reports, links). You grant us the simple, free right to show this content in the app while it is online.
Group rides and meetups
Group rides are organised by users, not by us. Taking part is a private meetup at your own risk. We do not check riding skills, licences, insurance or vehicles, nor routes or meeting points. Meet strangers in public places.
Creators, advertising and support
Creators are users we have verified with their own motorcycle channel. Their “My gear” link may contain ad or affiliate links and is marked as an ad; any contract is only with the shop. Creators label their own advertising and follow the creator rules. We receive no money for these links.
Voluntary support via Ko-fi is a gift without anything in return: it unlocks nothing and creates no claim. It is not a tax-deductible donation.
Reports, moderation, suspensions
You can report illegal or rule-breaking content in the app or to mirkogenovese91@gmail.com. We may remove content, hide links, restrict features or suspend accounts temporarily or permanently. We give the affected user reasons for each action, except for spam or where reasons would hinder an investigation. You can appeal within 6 months by email; a human reviews it again.
Liability
We are fully liable for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. As Moket is free, we are otherwise not liable for slight negligence. We are not liable for other users’ content or behaviour, user-organised rides, or the accuracy of reports, speed limits and weather data.
Term and termination
You can delete your account in the app at any time. We may end the service with 30 days’ notice or suspend an account immediately for good cause (e.g. serious or repeated violations).
Changes
We may change these terms when the app or the law changes. We announce material changes in the app at least 14 days in advance. If you disagree you can delete your account.
Law, contact, disputes
German law applies; mandatory consumer protection rules of your country of residence remain unaffected.
